What this website is, and what it does not promise

This is an information website. You cannot buy anything here, there is no account to create, and nothing on these pages is medical advice or a substitute for a device’s own instructions for use. These terms set out the few rules that come with reading it, and they are deliberately short.

The agreement

Who these terms are with, and what they cover

This website is published by Taiwan Main Orthopaedic Biotechnology Co., Ltd., trading as Surglasses, of Taichung, Taiwan (R.O.C.), together with its US subsidiary Surglasses, LLC. Where these terms say “we”, “us” or “Surglasses”, that is who is meant; “you” means anyone reading the site. Full addresses and phone numbers are in Changes and contact below and on our locations page.

By using this site you accept these terms. If you do not accept them, please do not use the site — that is the whole of the bargain, because we ask nothing else of you: there is no account to create, no subscription, no login, and nothing is sold or ordered through these pages.

These terms cover the website only. They do not govern the sale, installation, servicing or clinical use of our medical devices and educational systems. That relationship is governed by the written agreement between us and your hospital, institution or distributor, and by the instructions for use, labelling and training that come with each product. Nothing on this website changes, adds to or overrides any of those documents, and if this site and a product’s own documentation ever disagree, the product documentation is the one to follow.

Our privacy policy explains what happens to any personal details you send us, and it forms part of these terms.

Using the site

Read it, quote it, link to it

You are welcome to read these pages, print them, save them for your own reference, and link to any page from anywhere. If you are a journalist, a researcher or a clinician writing about our work, you may quote a short extract with attribution and a link back — you do not need to ask us first. Anything beyond that is covered by Intellectual property below.

What we ask you not to do is short, and none of it is unusual:

  • Do not attempt to gain access to anything not published here — including the staff editors used to publish our news and events pages — and do not probe, scan or test the security of the site or the server it runs on.
  • Do not place an unreasonable load on the site. Ordinary reading, ordinary search-engine indexing and ordinary archiving are all fine; bulk automated harvesting is not.
  • Do not misuse the contact form. It is for genuine enquiries. It is not a channel for bulk marketing, and it accepts five messages an hour from the same connection, which is enough for any real enquiry and not enough for a spam run.
  • Do not impersonate anyone or misrepresent who you are or which organisation you are writing on behalf of.
  • Do not send us patient-identifiable information. This is the same request our privacy policy makes, and it matters more than the rest of this list. If you need to discuss a specific case, say so in your message and we will arrange a proper channel with your institution.

Anything you do send us through the contact form — a question, a description of your requirements, a suggestion — we may use to answer you and to improve our products and this site. We will not publish your message or your name without asking you first.

Product information

Regulated devices, and what a web page can and cannot tell you

This is the part of these terms that actually matters, because we make regulated medical devices and teaching systems used by clinicians.

  • Nothing here is medical advice. The site describes what our products do; it does not tell any clinician what to do for any patient. Clinical judgement, the applicable standard of care and each device’s own instructions for use and training always come first.
  • Regulatory status differs from market to market. A device cleared, certified or licensed in one country is not automatically available in another, and the clearances and licences we actually hold are listed, with their numbers, on our Award & Quality page. Please read that page rather than assuming from a product page that a device is available where you are — and if you are not sure, ask us.
  • Product descriptions are information, not an offer and not a warranty. Model names, specifications, module availability and what is included in a configuration change over time and vary by market. Nothing on these pages forms part of a contract until it is written into one.
  • Published research is described, not promised. Where we cite a study, we say what it was — a pilot trial, a single-centre study of a stated number of patients — and we link to the paper so you can read it yourself. Where a figure was reported to us by an institution, we say that too. None of it is a prediction of what you will achieve.
  • No regulator endorses us. We state our regulatory status in words and numbers, and we deliberately show no regulatory agency’s logo anywhere on this site, because a clearance is not an endorsement and should not be made to look like one.

Intellectual property

Whose work this is

The text, photographs, product renders, animations, videos, page design and code on this site belong to Surglasses or to the people who licensed them to us, and are protected by copyright. Some of the photographs are licensed from stock libraries for use on this site, so they cannot be lifted out of it even where the rest of a page could be quoted.

Surglasses, Caduceus, Foresee-X, OOOPDS, Asclepius and our logo are trade marks of Taiwan Main Orthopaedic Biotechnology Co., Ltd. Please do not use them as your own, or in a way that suggests we endorse or supply something we do not.

Short quotations with attribution are fine, as set out above. Republishing a whole page, reusing our photographs or videos in your own materials, or building a product or dataset out of this site’s content needs our written permission first. Press, distributors and academic users: ask us — the answer is usually yes, and it is quicker than you expect.

Other people’s content

Links out, and names that are not ours

Several pages link to websites we do not control: news outlets that have written about us, journals hosting the papers we cite, the organisers of the trade fairs we attend, an app listing, an examination portal and our own social media profiles. Those links are there because they are useful, not because we vouch for what is on the other end. Once you follow one you are on someone else’s site, under their terms and their privacy policy, and we are not responsible for their content, their accuracy or their availability. Every such link opens in a new tab so that this site stays where you left it.

Names and marks belonging to other organisations appear on this site for identification: hospitals and universities that use our systems, the journals that published the studies we cite, the award programmes we have won, and the trade fairs we exhibit at. They remain the property of their owners. Their appearance here does not mean that organisation endorses us, unless the page says so in words.

One case is worth naming outright. The illustrations on our events page are, for most of the older listings, the trade fair organisers’ own promotional artwork, carried over from our previous website so that each listing is recognisable. They belong to those organisers, not to us. If you own artwork that appears on this site and would rather it did not, write to info@surglasses.com and we will take it down — we would rather remove a picture than argue about one.

Accuracy and availability

We keep it current; we do not guarantee it is perfect

We check what goes on these pages and we correct what we find to be wrong. But this is a website about products that change and about a regulatory position that changes with them, so the content is provided as it stands, without any warranty that it is complete, current or free of error. If something here matters to a decision you are making, confirm it with us before you rely on it.

The news and events pages are maintained by our own staff and show the position at the time each entry was published. An event listing is not a commitment that we will attend, and a news item is a record of what was reported then, not a statement about today.

We may change, move or withdraw any part of this site at any time, and the site may be unavailable while it is maintained or if something breaks. We do not promise uninterrupted access, and we are not obliged to keep any particular page or web address alive indefinitely.

Liability

The limits, and the limits on the limits

To the extent the law allows, we are not liable for any loss of profit, loss of business, loss of data or other indirect or consequential loss arising out of your use of this website, your inability to use it, or your reliance on anything published on it.

That limit does not apply to everything, and the exceptions are the important part. Nothing in these terms limits or excludes:

  • liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation;
  • any liability that cannot lawfully be limited or excluded where you live;
  • our obligations under any contract for the supply of our products, or the warranties given in it; or
  • our duties as a medical device manufacturer under the regulations of the markets we sell into — including vigilance and reporting duties, which a website notice could not waive and is not attempting to.

If you believe a Surglasses product has been involved in an adverse event, do not report it through this website’s contact form alone: follow your institution’s procedure and your national reporting route, and contact us directly as well.

Governing law

Which law applies, and in which language

These terms and any dispute arising out of this website are governed by the laws of Taiwan (R.O.C.), and the courts of Taiwan are where such a dispute would be heard. If you are a consumer somewhere else, this does not take away any right you have under the mandatory law of the country you live in, and it does not affect where you may bring a claim if that law says otherwise.

English is the language these terms are written in. If we publish a translation, it is offered for convenience; where the two differ, the English version is the one that applies.

If any part of these terms turns out to be unenforceable, the rest of them stay in force. Not enforcing something on one occasion does not mean we have given it up.

Changes and contact

How this page changes, and how to reach us

If we change these terms we will change the date at the top of the page, and continuing to use the site after that means accepting the new version. If a change is material we will say what changed here rather than quietly editing the text — the same commitment our privacy policy makes.
